You can search for patented cases that overcame Alice rejections in PatentAdvisor.
Click on the File Wrappers tab on the PatentAdvisor home page. This will take you to the File Wrappers search page.
In the Document Group dropdown list select "Office Actions."
Rejection Type (Office Actions) will appear as a search field. Select "References Alice."
To limit your search to patented cases, choose Application Status: Patented.
You have the option to narrow down your search to a specific examiner using the Examiner Name search field.
You can choose keywords in the Keyword Search. The Keyword Search accepts basic Boolean search terms, such as AND, OR, and NOT. Be sure to use parenthesis where order is important.
Select a date range, if desired.
The File Wrappers search results list will appear. Above the results list you can adjust your search terms or apply additional filters by clicking the "Filters Applied" button, shown below. Filters will appear in the sidebar.
You have the option to apply multiple filters to narrow down your search. For example, you might narrow down your search to a relevant Art Unit.
You can view each document in your result list individually by downloading the PDF or clicking the "eye" icon in the upper right corner of each result. Documents are OCR’ed and searchable.
|You can also click the hyperlinked application number to view the entire application in QuickPAIR.
|If you would like to save the list applications, you can export them to a briefcase. Hover over the cloud icon in the top right corner of the Results list and click “Export to Briefcase.” Briefcases save all information at the application (not document) level.
Add your results to a pre-existing briefcase under "Choose Briefcase" or create a new briefcase by creating a name and clicking "Assign Applications to Briefcase."
Your briefcase will be saved. It can be accessed in My Saved Work in the top menu bar of PatentAdvisor. If you would like to view statistics for this Briefcase or download case information, you can open the Briefcase and click on Dashboard Exploration.
You can also locate successful arguments against Alice rejections by searching File Wrappers for Response documents. You can do this in one of two ways:
Find response documents using your Alice briefcase as a filter. Simply search File Wrappers for Document Group: Responses and Application Status: Patented. When your list of results generates, go to the filter panel, select Custom, and select Briefcase. Search for your briefcase. Select your briefcase and click Filter.
|Simply search for Document Group: Responses, Application Status: Patented, and “Alice” in your keyword search.
